TERMS AND CONDITIONS
GENERAL PURCHASE CONDITIONS
1.1 These general conditions of purchase (hereinafter, the "Conditions”), are applicable to container, packaging and similar products (the “Products" or the "Product”) that DISTRIBUCION ARC offers through its website info@distribucionalesrc, with (the “Website”).
1.2 The Website is owned by ARC DISTRIBUTION, Spanish company, domiciled at C/ castell n1, alaquas, 46017 (valencia), provided with Y1069468M .
1.3 ARC DISTRIBUTION (“ARC DISTRIBUTION”) provides information about the Products, and offers the possibility of their acquisition through the Website. People who intend to acquire the Products must complete the respective registration form prior to the purchase process and follow the instructions that ARC DISTRIBUTION will indicate through the Website.
1.4 These Conditions, together with the Legal Notice contained on the Website, are the only conditions applicable to the use of the Website and the purchase of Products through it and replace any other conditions. Consequently, the Client (the “Client”) who accesses the Website, registers or purchases Products through the Website agrees to submit to and is bound by these Conditions and the Legal Notice as written at the time the Website is accessed. .
1.5 All Clients who access and register on the Website must be at least eighteen (18) years old or, if not, have the authorization of their parents or legal guardians.
1.6 The contract is formalized in Spanish and is regulated by Spanish legislation, specifically by Royal Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws (“LDCyU”) and by Law 34/2002, of July 11, on Services of the Information Society and Electronic Commerce (“LSSI”).
2. Product Information
2.1 The photographs, graphic or iconographic representations and videos related to the Products of ARC DISTRIBUTION, as well as trade names, trademarks or distinctive signs of any kind contained on the Website, are intended to provide the most descriptive information about the Product. ARC DISTRIBUTION will take all reasonable care to ensure that the description of the Products that appear on the Website is correct. However, the Client must bear in mind that they are for guidance only and, consequently, they are not exhaustive, so it is not guaranteed that the descriptions and images of the Products are exact, complete, reliable, up-to-date or free from mistakes.
2.2 ARC DISTRIBUTION reserves the right to decide, at any time, the Products that are offered through the Website. Thus, ARC DISTRIBUTION may, at any time, remove or add Products, it being understood, unless otherwise provided, that the new Products will be governed by the provisions of the Conditions in force at that time.
2.3 In the event that, due to circumstances of force majeure, a Product is not available after the purchase has been made, ARC DISTRIBUTION will inform the Customer by email of the total or partial cancellation of the order, and in turn, the Customer will have the right to be refunded the amount paid for the Product. The partial cancellation of the order does not entitle the cancellation of the entire order, without prejudice to the exercise of the right of withdrawal that corresponds to the Client in accordance with the provisions of these Conditions.
3. Place Orders
To place an order, the customer must follow a series of simple instructions that appear on the Website.
3.1. The customer must select the products they wish to buy by pack or individually according to the desired product. Once you have finished choosing said product, you must click on the “Add to cart” button.
3.2. Once the product has been selected, the customer has the option of choosing the compatible items that each product offers in his case. Once you have finished choosing that product, you must click on the "add to cart" button.
3.3 These products will be automatically added to the customer's shopping cart, located in the upper right corner, indicating the price of the products added. The customer can check all the items in his shopping cart at any time.
3.4. The process of adding other products to the cart will be carried out in the same way.
3.5 Once the purchase is complete, the customer must click on their cart (located in the upper right corner), the purchase summary will be displayed and they must press the "Finish purchase" button.
3.6 The customer must register in order to place the order. If you are a new user, you must fill in the required fields at login. If you are already a registered user, you must click on the registered customer tab and enter your email address and password.
3.7 Once registered, the customer must choose between warehouse collection or shipping. There are two types of shipping STANDARD SHIPPING (3-6 business days) or EXPRESS SHIPPING (24H – 48H business days) which carries a supplement. If you choose warehouse pickup, you will need to choose our warehouse address.
3.8 Next, the customer must choose the payment method. If the customer has a promotional code, they must enter it at that time so that the corresponding discount is applied before proceeding to pay for the order. For order shipments, payment by bank card, Paypal or bank transfer is allowed. If the customer chooses warehouse pick-up, they will have the methods described above plus cash payment upon pick-up.
3.9. The customer will see a detailed summary of his purchase: the products and quantities he has ordered, the total amount (including taxes and shipping costs), the shipping address or the address of our warehouse (for orders with warehouse pickup), the payment method, the shipping method and a field where the customer can indicate notes regarding the order. All this data can be modified using the modify button (located next to the various sections of the order detail). In case of making the payment by bank transfer, the client will see below said order detail, the bank account number where the payment must be made.
3.10. Finally, the customer must press the Confirm purchase button, located below the order detail. You will receive an e-mail confirming your order.
3.11 By placing an order, the Customer acknowledges and declares that they have read all the instructions given during the verification process and fully accept these Conditions. The Customer formalizes an order for Products through the Website by clicking on the "Place the order" button at the end of the purchase process.
3.12 Once the order has been submitted, a page will appear with the phrase "Thank you for your purchase" and within 24 hours of receiving acceptance by ARC DISTRIBUTION, the Client will receive in the email address that he had provided to ARC DISTRIBUTION, an acknowledgment of receipt confirming receipt of your acceptance along with a summary of the conditions, information on the characteristics of the Products purchased, the price, the method of payment and information on shipping costs.

4. Shipping and Delivery
4.1 Orders are processed, processed and delivered on business days and during customer service hours from 9 a.m. to 6 p.m. Orders placed on Fridays outside of business hours or on weekends and holidays will be processed the next business day.
4.2 Shipping costs are paid by the Customer and are reflected in the invoice.
4.3 The maximum delivery period for the Products is 30 calendar days from the conclusion of the contract.
Shipments to Spain (peninsula) take approximately 2 to 6 business days once payment has been confirmed by the Client. In international shipments, the delivery time can be between 3 to 7 business days, depending on the destination, the selected service and the indicated transport company. Once the package is delivered to the courier service, the Customer will receive an email notification with the shipment tracking number.
ARC DISTRIBUTION is not responsible for delays in the delivery of orders, or the impossibility of carrying them out, when the cause is due to an event of force majeure, and therefore, beyond the control of ARC DISTRIBUTION. Among other causes, we understand that force majeure exists in the following cases, which are not exhaustive: accidents, strikes, riots, threats or terrorist attacks, fire or explosion, meteorological causes or natural disasters such as storms, floods, earthquakes, subsidence, epidemics, as well as like any other problem ARC DISTRIBUTION in means of transport or telecommunication systems. As far as possible, once the cause of impossibility or delay has ended, ARC DISTRIBUTION will do everything possible to resume its commercial activities and to be able to fulfill its obligations and shipments.
4.4 All purchases are subject to prior authorization from the bank. Only purchases with prior authorization will be processed. If the order cannot be processed, the Customer will receive an email.

The Products will be charged at the time the order is placed.
For Customer security, Customer's billing name and address must match that of the credit card used to make the payment. We reserve the right to cancel any order that does not meet these criteria.
All credit card holders are subject to validation and authorization checks by the card issuer. If the issuer of the Customer's payment card denies, or for any reason does not authorize, the payment in our favor, either before or after a payment, we will not be responsible for any delay or non-delivery.
Paypal linked to your debit card, credit or bank account to your Paypal account does not apply costs except in the case of currency conversion.
5.3 Bank transfer

5.4 Cash on pickup
The Customer can choose the option of personally collecting the Products purchased, by going to the following address:

This method of payment must be indicated at the time of placing the order and the amount of the purchase must be provided exactly at the time of collection since there is no cash. To pick up the Product, it will be necessary for the Customer to have received a notice electronically along with a number confirming that the Product is ready to be picked up.
6.1 Shipping costs are calculated based on the amount of product purchased, the volume it occupies and the destination.
6.2 The Canary Islands, Ceuta and Melilla are not part of the customs territory of the European Union, so shipments may be subject to taxes and/or customs duties. In most cases, the fees are collected at the time of delivery of the package, although the Customer may receive a notification by mail requesting that they go personally to pay said fees in order to receive the package. The amount of the fees may vary depending on the weight/amount of the package. In the case of shipments to the Canary Islands, ARC DISTRIBUTION includes in the shipping cost the Single Administrative Document ("SAD”) for export, and upon delivery of the Product, the Client/recipient must pay the DUA for Importation and the General Indirect Canary Islands Tax (“IGIC”).
7. Order inquiries
7.1 Without prejudice to the provisions of point 4.5 of these Conditions, the Client who has created an account in email@example.com You can check the status of your orders by visiting the “My Orders” page in the “My Account” section.
7.2 When the Customer clicks on the “Order Status” page, they will be required to log in with their email address and password. 8. Cancellation of orders
8.1 ARC DISTRIBUTION You can cancel orders for the following non-exhaustive reasons:
– Inability to process payment information.
– Impossibility of making the delivery to the address provided.
– Cancellation at the request of the Client.
– Items not available.
9 Other features of the purchase
9.1 Shipments are made by courier service or groupage.
9.2 Shipping costs include Value Added Tax (VAT) in all cases.
9.3 Shipping is understood as the delivery of the Products to the address specified by the Customer during the ordering process.
9.4 ARC DISTRIBUTION deliver the orders to the courier service within a maximum period of 48 hours.
10. Right of withdrawal
10.1 The Customer may exercise the right of withdrawal without indicating any reason and return the Product to ARC DISTRIBUTION within fourteen (14) days from the day you acquire physical possession of the Product.
10.2 To do this, the Client will be required to notify in writing to ARC DISTRIBUTION to the email address firstname.lastname@example.org indicating the data necessary to locate the order in question. As soon as ARC DISTRIBUTION receives the email with the order data, the procedure to be followed will be communicated to the Client.

10.4 The right of withdrawal will not apply to the delivery of the following Products:
- Made according to the Client's specifications or clearly personalized.
- They can deteriorate or expire quickly.
– Sealed items that are not suitable to be returned for reasons of health protection or hygiene and that have been unsealed after delivery.
11. Effects of withdrawal
11.1 The Client must send the Product, in perfect condition, to the address indicated ARC DISTRIBUTION, no later than within fourteen (14) calendar days from the date on which you communicate your decision to withdraw to ARC DISTRIBUTION. In these cases, ARC DISTRIBUTION will reimburse the Customer for all the costs of the original purchase except for the direct cost of returning the Products, which will be borne by the Customer. Likewise, the Client will only be responsible for the decrease in the value of the goods resulting from handling them other than what is necessary to establish their nature, characteristics or operation.
11.2 ARC DISTRIBUTION will use the same means of payment that the Client would have used for the initial transaction.
ARC DISTRIBUTION may withhold the refund until it has received the returned Product(s) from the Customer or until the Customer provides proof of having returned the Product(s), whichever comes first.
12.1 ARC DISTRIBUTION It is responsible for the lack of conformity that manifests itself in the Product during a period of two (2) years from the delivery. Therefore, if the Product is defective, ARC DISTRIBUTION will be in charge of collecting it and exchanging it for another of identical conditions, taking charge of the costs associated with this return and exchange (except for those additional expenses resulting from choosing an urgent delivery method). , in which case the Client must assume the extra cost).

12.3 The Client must inform ARC DISTRIBUTION of the lack of conformity of the Product within two (2) months of becoming aware of it.
12.4 In the event that it is not objectively possible to substitute the Product for another of the same class, ARC DISTRIBUTION will proceed to refund the price thereof.
12.5 In no case will the guarantee provided in point 12.1 cover the negligent or violent use of the Product or the damages derived from the manipulation or intervention of the Product.
It is equally important that the eventual instructions for use or installation of the Products that are delivered be followed at all times, and in case of doubt, you should contact ARC DISTRIBUTION to receive advice on the use of the Product.
The prices include in all cases the Value Added Tax (VAT), as well as any applicable tax or fee.
The Products will be sold at the price indicated, being the price that is collected at the time of the confirmation of the order by the Client.
ARC DISTRIBUTION reserves the right to modify prices, articles, offers and other commercial conditions without prior notice.
16.1 The lack of requirement by the ARC DISTRIBUTION of strict compliance by the Client with any of the obligations assumed by the Client under a contract or these Conditions or the lack of exercise by ARC DISTRIBUTION of the rights or actions that may correspond by virtue of said contract or the Conditions, will not imply any waiver or limitation in relation to said rights or actions nor will it exempt the Client from complying with such obligations.
16.2 No waiver by ARC DISTRIBUTION to a specific right or action will imply a waiver of other rights or actions derived from a contract or the Conditions.
17. Modification of the Conditions
ARC DISTRIBUTION reserves the right to review and modify these Conditions at any time. The Client will be subject to the Conditions in force at the time he uses the Website or makes each order, unless by law or decision of government agencies ARC DISTRIBUTION must make retroactive changes to said Conditions, in which case, the possible changes will also affect the orders that the Client had previously made.
18. Complaints, comments and suggestions

19.3 So that the information contained in our files is always updated and does not contain errors, we ask the Client to notify us, as soon as possible, of the modifications and rectifications of their personal data.

19.5 Except in the fields in which the contrary is expressly indicated, the provision of information required in the data request forms is mandatory for the correct management of the orders, queries and suggestions made by you. The lack of completion of the fields determined as mandatory, or the provision of incorrect data, will make it impossible for ARC DISTRIBUTION can properly manage them.
20. Applicable law and jurisdiction
20.1 These Conditions are governed and interpreted in accordance with Spanish law.
20.2 The parties agree to submit the decision of the matter raised to the Courts and Tribunals of the city of Valencia (Spain) except in the case in which the Client is a consumer for the purposes of article 3 LDCyU, in which case the Courts and Courts of the Client's domicile or ARC DISTRIBUTION, as chosen by the Client.
